Community Forums Terms of Use
Community Forums is a hosted forum solution developed by MySite for use by our clients who are the Owners of individual Forums. Your use of this website is subject to these Terms of Use.

Forum Rules

By registering as a User you agree to abide by the following rules and understand that failing to follow these rules may result in the removal of your Comments from Forum Discussions and the suspension of your User Account.
  1. Respect – your Comments must be respectful of other Users, Forum Owners and of MySite. Abusive, offensive, obscene, vexatious or otherwise inappropriate Comments may be removed from Forum Discussions. The use of nicknames which contain abusive language or attempts to impersonate other people may result in the suspension of your User Account.

  2. Privacy – Comments which contain personal information such as names, email addresses and phone numbers or private correspondence may be removed from Forum Discussions.

  3. Lawfulness – Comments which are defamatory, discriminatory, infringe copyright or intellectual property rights or otherwise violate the law may be removed from Forum Discussions.

  4. Truthfulness – Comments which are considered to be false or misleading may be removed from Forum Discussions.

  5. Relevance – your Comments and any links in your Comments must be relevant to the Forum Discussion in which they are posted. Irrelevant Comments and Comments that endorse or promote commercial products or services may be removed from Forum Discussions.

  6. Brevity – your Comments must be concise and to the point. Excessively long Comments may be abbreviated or removed from Forum Discussions. Excessive posting of Comments in a Forum Discussion may result in the removal of your Comments or suspension of your User Account.
Moderation and Reporting Abuse

MySite and Forum Owners may Moderate Forums. Comments that you submit to a Forum Discussion may not be published immediately, may never be published and may be removed at Our discretion or the Forum Owner’s discretion if they contravene the Community Forums Terms of Use. We will attempt to notify you by email if your Comment has been removed.

All Users are encouraged to alert Moderators about Comments which they consider to be in violation of the Community Forums Terms of Use. Alerting Moderators to such Comments does not guarantee their removal.

Your Comments

You understand that you may be held legally responsible for any content you submit. You indemnify MySite and Forum Owners against any claims arising from content you submit.

You understand that any Comments you submit will be stored in a database and agree that MySite and Forum Owners have the right to use your Comments online and in any other manner they choose both now and in the future.

Your Privacy

MySite will not share your personal information with Forum Owners or with any other third party under any circumstances, unless required to by law.

Security

You understand that you are responsible for the security of your User Account password(s) and all submissions made from your User Account.

Availability

You acknowledge and agree that, as with all computers and internet-driven software applications:
  1. There may be times when our chosen server is not operational or has been shut down for maintenance.
  2. There may be software errors or other interruptions affecting our chosen server or the application.
  3. Despite taking all reasonable security measures, our chosen server is vulnerable to hackers, viruses, and unauthorised access and we cannot guarantee the integrity of data and, that as a result of any of these events, there may be interruptions in use.
Termination

You may close your User Account whenever you wish. You should note that any Comments you have made in Discussions may still be visible after your User Account is closed.

If We believe that You have violated the Community Forums Terms of Use, We reserve the right to terminate your User Account without notice and without any liability to you.

Liability and Indemnity

You understand that Comments submitted by Users of Community Forums express the views and opinions of those Users and not MySite or Forum Owners. You also understand that some information on Forum pages is submitted by Forum Owners and not by MySite. We make no representations as to the accuracy of any such information and take no responsibility for it.

You use Community Forums at your own risk. MySite provides Community Forums without any express or implied warranties and MySite is not responsible for the activities of third parties using Community Forums. You indemnify and release MySite, its directors, officers, employees and agents from any claims and damages, known and unknown, arising from or connected in any way with any claim you have against such third parties.

Changes

MySite may change the Community Forums Terms of Use at any time without notice to you. You are expected to check this page from time to time to ensure you are complying with the current Terms of Use.

Definitions
  1. Community Forums: The services made available through the website at www.communityforums.com.au and any other subdomains or co-branded websites using the Community Forums software platform.

  2. MySite: MySite Design Pty Ltd - ABN 47 104 027 812 - the developers and owners of Community Forums.

  3. Forum Owner: A client of MySite who has purchased and administers a Forum at Community Forums.

  4. User: A person with a Community Forums User Account.

  5. User Account: The login account created using the registration tools at Community Forums.

  6. Moderator: A User with special priveleges in a Forum who may approve and reject Comments.

  7. Forum: A collection of related Discussions.

  8. Discussion: A collection of Comments made on a particular topic.

  9. Comment: An individual text or html submission made to a Discussion by a User.
